Hello all,

We have a contract on a vacant foreclosed home in Plantation, Fl and are closing on Monday, March 1.

We went by the house today, to take some pictures and found someone living in the house claiming that they are renting the house from its owner. Let's just say that I went crazy, I called my realtor and the listing realtor who came out and brought the police with them.

The "owner" of the home claims that he took posession of the house 2 days ago because it had been abandoned for more than 90 days. He filed a quit claim deed with Broward County.

The listing agent explained to the police officers that the house was not abandoned and was under contract from early January. The water and light bill were in his name and there was work being done on the house as recently as last week. The officers said that they could not tell these people to leave and we had to go to court.

These people moved in Friday night. All the neighbors came out and were just shocked at what was happening.

What can we do? We have a contract with the bank on this house.

Please help us. This is our dream house and we are afraid that these people are going to wreck it.

The current owner (the bank) will likely have to go through an eviction process to get them out. Since you are not the owner, it's likely you can't do anything. You should not close on the house until the bank corrects the situation. Recommend you talk to an attorney.

Why are you worried they will wreck your house? Do they appear to be unscrupulous? If they are good people they will move out based on principle? What was their reaction when the police showed up? Just out of curiousity, are the renters or "owner" from the US originally?

They are squatters and the bank has to evict them.

Amerifree, when they police arrived the so called "owner" of the house told me that he could get me another home and make me a millionaire in the process.

They moved into the house in the middle of the night, the neighbors never saw any moving trucks.

After the police left and we spoke to the neighbors on the sidewalk away from the house, the police returned because they were called by the "owner" stating that we were yelling and threatening to break out the windows in the house.

UNSCRUPULOUS --- YOU BET!!!

I am so sorry that you have to go through this. I had no idea. Best to get your earnest money back and find another property. This one might be tied up for a while.

Good grief.

Do they appear unscrupulous? Well DUH ... they moved into a house that wan't theirs to move into. They moved into the house in the middle of the night. Of course they are not voluntarily going to move out.

And what does their origin have to do with it?

Okay have you seen the statute that these folks say there are invoking? Have you gone to the county to see a copy of the "quit claim deed" that they filed? A quit claim deed has to be signed by the owner of the property and it is also not a guarantee that the title transfer is valid.

The statute they are using states that the house must be abandoned for 90 days. It is Vacant, not abandoned. They were repairs being done to the house per our contract with the bank just 2 weeks ago. We have a copy of the invoices and pictures.

It was put on the market 2 months after the owner was foreclosed on (October) and we had a contract on the house by mid-January. The quit claim deed has NOT been signed by the owner (the bank).

The neighbors have been wonderful. Someone contacted the local news and they knocked on the door last night. No one answered.

We plan on returning to the home today with a news crew and we are going to the courthouse tomorrow to prove that the house is owned by the bank and was not vacant.
