I'm really hoping he does break things off with her so he can pursue me. I'm going to keep flirting with him and see what happens. I really like this guy and its rare that I get "butterflies" around someone I like. I don't want to pass up on this opportunitiy

There's no home to wreck, they have no children and they aren't married. By law, he is single. Now, if he were married then that would clearly be wrong, because he made vows before God. But that is clearly not the case here.
He may not have made vows before god but he is faithull to his gf and that's what matters he knows where his heart is and its not with you obviously ding ding
