There's no way he'll win - and I feel terrible for their kids. He's most likely just doing this to harrass and embarrass her, but the kids will be most hurt by these parents actions.

He might win. He's not asking for the kidney back, just the value of it in the split of assets. It all depends on whether NY is a fault state or not. NC is not unfortunately.
