I only partially agree. First, they have to stand behind the restraining order.
Any half decent, competent police officer, is going to ask questions
to determine how his black eye came about unless he's Barney Fife.

Its an officer's duty to investigate to get further information, to make reports and arrests.

I thought if there's a restraining order; both go to jail if they're found in eachother's vicinity , like in the same car..
I was told ages ago in Pa when I got one against my ex if I were found in his town(I moved 60 miles away to get away from him) I'd be arrested just like he would be if he were in my street, and the order would be void. Don't both parties get arrested in domestics lately? Or is that a state by state thing?

Good question. I wish I knew the laws on that here in TX, but I havent gotten a restraining order yet. Anyone know where I can look that up?

Its probably has alot to do with state. They question alot to figure out if they should arrest one or both.

In domestic cases in PA, subpoenas are sent out so you have to show up in court, judges and police are tired of having there time wasted.

In NYC there is such a thing as the "Primary Aggressor" which basically means they size up the individual who is "more likely" to do the hitting, and lock him/her up based on past history of abuse etc. etc. Usually both parties should be arrested if there are injuries to both people. In cases of domestic violence 10-1 the man WILL get locked up because he is USUALLY the one doing the hitting. In the rare case the man is the victim (EXTREMELY) the woman may be arrested, but I've seen cases where when the police show up all the woman does is cry and EVEN with scratches on the man's face (and not a scratch on the woman) the man gets locked up. That's just the way it is in most states. Cops don't want to be held accountable for someone getting seriously hurt or killed, so they just lock the man up and let the court decide how it will play out.

If there is a valid order of protection the Cop's hands are tied and they MUST make the arrest.

Here in TN my dh has an order of protection against his babysmama for breaking into our house. The order states that if he violates it then he gets a fine in the minimum of amount of 200 bucks. They dont take the order very seriously here either because she still calls my dh all of the time leaving threatening messages and when he answeres she hangs up. The cops do nothing about it and he even took it to the DA who laughed and said that he cant prove its her since the number she called from was a prepaid and she didnt leave her name.
