I imagine it would be the same as when rulings come down on things like praying in schools and such.
1st...a case has to be brought, noting the law not being followed.
Interpretations are made of what is written in the law...and it is determined by that judge whether some activities pass muster.
I would think PL 97-280 could certainly be cited as a defense in some actions.
Then why isn't it? Are the lawyers just too dumb?

Exactly what kind of community do you live in that is not predominantly christian?
