I am considering this heavily. I need to save some money to put a down payment on a house though.
Also, I'm not trying to sound like I'm unsympathetic to the landlord. I've been very lenient with the issues I've dealt with so far. I have even praised his maintenance crew for doing an excellent job. I was just curious about what kind of rights one has if the issues are recurring over a long period of time, for future reference primarily.
I hear quite often people defending businesses as if they have little responsibility in the business-client relationship (as if they're owed some sort of leniency), so I can get a little perturbed about that. I don't mean to come across as crass to anybody on here.
Hello all. Question: I live in TX... What if the maintenance issues start out as an emergency and are not addressed in a timely manner, causing damage to the apartment? My AC had a leak, I made an emergency maintenance request and they waited 24 hrs to come out. Meanwhile the walls and carpet got soaked. When they did come out to fix it, it wasn't repaired properly so it continued to leak. Meanwhile the carpet and walls became infested with mold and I have a small dog so it became unsafe to live in. I called them again and again it took them a couple of days to come out. Meanwhile I moved in with my bf until the work was done. It took them two weeks to complete the job! Then the workers left my place a mess. The paint machine that led from their truck to my apartment left paint splatter all over my front door, side walk and entry way. They then left the piece of carpet in the coat closet that is infested with mold and paint splatter... I can't put my coats back in there! I complained several times, all of which went unheard. I decided to write corportate because I wanted the paint mess cleaned up, a new piece of carpet for the closet and I wanted compensation for not being able to live in my place for two weeks. Well corporate wrote back saying they forwarded my email to the district manager here but I have not heard from that person either and that was two weeks ago. The mess still remains as does the moldy carpet. I'd like to know if there is something I can do to get the issues resolved. Any suggestions??? Thanks!!
My apartment hasn't addressed issues I have as well. We have Roaches/ Water bugs to the point there in our appliances, our shoes and even living in our alarm clocks and refrigerator. This morning I woke up and my fridge was broken, I immediately called maintence and they told me there was nothing they could do just take my food and put it in a cooler with ice until they can find me a fridge the do not know when this will be. Our stove throws blue flames when we try to use it, the ceiling fan in the bedroom is broken. Ive sent a letter to their main manager and recived a letter back stating everything should be fixed within days. This was over a month ago. We broke a window in October, and they added the charge to our rent, which now has us going to court for unpaid rent. We've been trying to figure out what to do the window is now broken again (on its own this time) and they could possible charge us for it. We are trying to move as our lease is up in March, but we cannot get accepted anywhere due to the 488.00$ charge of the window they added to our rent. WE could possibly be evicted because of this charge and every month they add more charges. Please help, im not sure who to contact, we have very little money none for a lawyer but I hate the fact that im sleeping beside an alarm clock filled with bugs. And the 165.00 in our fridge is now gone bad because of the fridge please help me. I live in Richmond, Virginia

You need to separate your unpaid rent issues from the other problems. Pay your rent or you are not going to get to sleep next to that alarm clock anymore and you will probably have bigger problems to worry about. Yes you could very well be evicted. No one can help you stay where you live if you do not pay the rent and repair bills you are responsible for. Once you have done that, then you may be able to pursue getting other things fixed, but no landlord is going to spend much time following up on repair complaints from someone who has not paid their bills.
Meanwhile, you are certainly capable of buying an ice chest for your food, and a few cans of Raid insect repellant to take care of some of the infestation problems you complained about on your own. You are not helpless, take some responsibility for your life and take action.
You probably can find some other place to move to if you look hard enough, as not all landlords are good about checking past references.
I go to work and school at the same time and I'm not able to sleep in the apartment I pay no late rent because of the activities of people living upstairs. The management refused to do nothing about it. I'm going crazy and about to lose my job because my supervisor caught me sleeping. She let it go because I wasn't the kind of person to sleep at work. I can't concentrate on my studies either. Pls help me
I'm writing this message in the middle of the night because I'm not able to sleep. And I have to wake up 5:00am tomorrow morning to prepare for work and from work to school. My eyes are burning so bad and feel like crying. It might look as like easy matter but seriously it affecting my life. The last time I complained to super he said the person is an elderly women and he wouldn't know how to address the issue with her. I can cope with the rats but definitely not sleepless night. This happens anytime of the day even weekends I cannot read or take a nap.

If the upstairs tenants are making excessive noise during the night then you should notify your LL in writing. Likely the only solution is to move and maybe your LL will let you out of your lease without penalty.
Hello all. I was hoping somebody would be able to shed some light on what rights I have in regards to my rental situation.
I began renting an apartment in October of 2010. I live in a somewhat mild climate, so it doesn't really start getting cold here until late November, early December. Since about December, I've been experiencing recurring heat issues. The first time, which was probably in early December, I woke up in the morning and had no heat or hot water. They came out and fixed it fairly quickly, but I also had to miss the first half of my work day.
I have a radiant heat system in my apartment. About a month ago, it went on the fritz. I could not control the temperature in my apartment through my thermostat. I had it set at about 68 degrees, but my apartment was around 80 degrees. About this time, a new management company had purchased the property. Their maintenance crew has been very prompt and very kind. Anyways, they came out to fix that issue, and once again, I had to miss the first half of my work day. This particular issue took about a week of them coming out to finally figure out what was wrong. Eventually it was fixed. So for a couple weeks, everything seemed to be fine. Then, this past weekend, the radiant heaters started making an irritating, loud clanking noise. I called maintenance and they claimed to be sending someone out Monday afternoon. When I came home from work Monday, the clanking sound was louder than it had been the night before. So, I emailed them again and they sent someone out yesterday. When I got home, everything seemed to be good. No clanking, heat was working accurately.
Just when I thought I was free, I woke up this morning to no heat and no hot water. I sent an email and left a voice message to maintenance expressing how dissatisfied I was. The asset manager himself promptly returned my call and told me how they were dumping all sorts of money into this building because of these issues. Also, when they bought the building, the previous owners did not tell them about these recurring heat issues. Anyways, he explained that someone would be out later this morning because maintenance had a meeting. Once again, I'm missing the morning half of work.
Now fortunately, my job is somewhat lenient where I can work from home, if necessary. BUT, I feel like every time I have to send my boss an email that I'm not going to be in this morning, that it doesn't put me in a good light. So my lease is up in April of 2011. To you property managers and experienced renters out there, do I have any rights? Can I get out of this lease prior to April so that I can move into a more stable environment? I mean, when my living situation is affecting my work this much, am I able to do something about it? I don't want to get written up, or worse, lose my job over this.
What should/can I do?

Hon I'm sorry your having so many problems but you need to just move! I'm glad you didn't say anything crazy like you called maintenance at 2am or six am. Look these people work really hard, and I'm sure they'd rather fix the problem than be dragged away from their families time and time again over some annoying customers! If your having hear problems and maintenance isn't fixing it than call someone else or do research. Many times the problems tenants have can be fixed without calling maintenance but women more than anything act as if they cant do their own repairs. I'm a woman and I own my place. If I don't want to spend money calling maintenance I can simply do research and get the tools I need to fix my drains and toilet problems. When in owned an apartment I never called maintenance unless I was sure I couldn't fix the problem myself. I hate hate hate annoying customers that always need something fixed. The maintenance guys already work nine to five and get called in all the time after work many times on holidays! I once went with my guy on a maintenance call on Christmas and it took everything not to ring the customers neck! She had heat problems! My thing is if they can't fix it than instead of calling over and over again whinning about the same heat problems, get a heater lol those work great in a bedroom. Lol I don't know how you people are going to own homes without spending loads of money on outside maintenance just because no one ever tries to figure it out themselves. BTW I'm guessing there's something logged between your heaters fan or near it causing clicking noises.
