I have a home in Albuquerque that I was renting out. The renters have decided that they are done paying. In the state of New Mexico, can I sue for unpaid rent and eviction expenses in small claims court?

Find out the court where evictions are filed. There you will be able to get all the information you need. They probably have a website, just type in "X Y Z county, New mexico" into google search, and it will bring up all the official websites. click around until you find what you need.

You might post this on a New Mexico forum, someone who lives t here could tell you where evictions are filed.

Basically, you will probably need go through with a formal eviction.

When does their lease expire? Still months left on it? What is your policy when someone breaks a lease? Where are you located, in the same town?

You cannot actually evict in small claims court but yes you can sue for rent and anything else in small claims court.
