Hello all,

Two weeks ago my husband & I submitted a lease application for approval to the HOA in Miami Beach. The owner said we have the unit and removed the listing from MLS, so we thought we had it. Our move-in date is 6/24- Friday! Movers are booked, boxes are packed!

However, we still have yet to hear if we are approved from the HOA. I know that this past Monday a credit company called our employers, banks, and referrals, and asked for our paystubs and tax returns. They said they have no further paperwork pending.

Our realtor says we just need to wait but it is 2 days left to move date. I want to call the HOA myself and/or owner's realtor and say I don't want to be pushy but we need to know. Can I do that??

Under the circumstances I would call the HOA and tell them the situation you are in and want an answer. Even a verbal answer. Depending on the answer, tell the realtor you called and want the lease drawn post haste. If you do not get a decision, call the realtor and demand an answer and a lease.

Normally, the owner and their real estate agent communicates with the HOA. You need to be riding the real estate agent and the owner on this. One question, how did that move in date come to be?

Hello and thank you for your advice After being frustrated for long enough & doing lots of legwork, I am happy to report a positive outcome, we are moving in!

The day we submitted lease app 6/6, it was agreed upon by both realtors that move in date was 6/24. We waited, and waited for an answer.

Basically, my realtor kept saying he wasn't hearing a response from the owner's realtor. So, I called the owner's realtor who gave me the # to the property management co. They said my file wasn't received till 6/17 even though we submitted it to the owner's realtor 6/6! Then our file went for a VERY thorough credit, employment, criminal, bank account and personal reference background check on 6/20. I sweetly harrassed the PM company, owner's realtor AND credit agency to rush this since it was submitted by us on 6/6! Someone was sitting on the app, may never know who? My guess is the PM company that sat on the app.

Finally, 5pm before our move-in day I get a call from the HOA rep wanting to interview me over the phone and said he approved us but has to submit his report and all our paperwork to the rest of the board as a courtesy, so our move-in date is now pushed to Monday 6/27. I reminded him of the agreement and told him we would lose our mover deposit but that didn't matter to them. I am even wire transfering the monies due into the owner's escrow account for Pete's sake!

The lesson I learned is no one cares about your own paperwork but you! So, take matters into your own hands. My realtor profusely apologized that his own client was able to solve this faster than he.
