Why are you asking people on this forum? You need to go to the city hall, courthouse ,or Police Station to find out how to do this. They can give you specific information for your area.
I'm sure you will have to get the police involved at some point. I would get a free consult with a lawyer only if nothing else works. It may cost you some money though to get these losers out. So much for being nice and trying to help someone when they're down....

He could get free counseling from a lawyer over the phone on something like this. If he calls a guy who's a one-man operation, or two lawyers sharing an office, they often answer the phone themselves. You can ask them what to do in a situation like this, and they'll often spend 10 or 15 minutes on the phone with you for free.

I am a property Manager in Ohio and my tenant allowed his adult son to stay a few days and now his son refuses to leave. I don't want to evict my tenant. He is an excellent tenant. He has broken his lease by allowing his son to stay but I don't know many parents who wouldn't have done the same thing. I have called our county Sheriff office and our local police dept and been given bad advise from them. It depends on what day I call as to what they say I should do. Police have been called to the residence several times because my tenant works away from the home during the week and the son has people in and out at all hours the entire time his father is gone. We suspect drug activity. The son even has a warrant and local police do nothing. My lawyer told me to evict the tenant and rent to him again, but then my tenant has an eviction on his record. I was told to have my tenant evict his son. Can I do this in Ohio? Can a tenant who does not own the property evict an unwanted guest in his rental property? I have been searching for days and can't seem to find the answer to this question. I don't trust law enforcement's answers.
Or does anyone have any other suggestions to get this person out here?

Tell your tenant you are evicting him unless his son is gone in 48 hours. Then do it.

You're a property manger and you are asking us what you can do?

My advise, get of of the business! It's one thing to ask advice on if "A" or "B" is the best action; it's another thing to ask what you can actually do based on the law. If you don't know the laws, you're over your head!

About 15 years ago I was living in a rental where the upstairs neighbor, who I will refer to as "Stompy," allowed her recently paroled son to move in. (I used to call him "Stompy Jr.")

He was an intimidating sort and was engaging in all sorts of petty, illegal activity (selling dope and breaking into the coin boxes in the laundry room for example). He also would have people over at all hours who would stomp along with him and his mother until I felt like I was living under the Budweiser Clydesdales.

Our property manager was great, always on the ball, and the only way he was able to get this guy out was when enough police reports were filed that he was then able to initiate an eviction. I believe the last straw was when he tried to break into another neighbor's apartment and they caught him. The noise was so bad for me that I was glad to see him go, but Stompy Mom was so bad that I eventually moved. (The prior tenants were great and had carpeting that management tore out when they moved)

Let me add that Stompy Jr. was on the lease. The management company required you to let them know if someone moved in and then would usually tack on an extra $50 to the rent since it was after the fact of you signing the lease.

I'm curious. In my state you have to have a real estate agent's license to be a property manager. I looked up Ohio and it says you have to have a BROKER'S license, which is an even higher level.

Wouldn't you know the eviction laws?

Could some of the freeloaders be bluffing about threatening you with "you will have to take me to court to get me out" and "you have to give me 60 days according to the law, etc"


Really? If you listen to them, you are stuck.


What happens if you turn the tables on them, and make them move out, can they really take you to court and it turn out bad for you? Or maybe its just them bluffing to intimidate you to keep them there.
