Wait a second...
what *exactly* does your bill say?
Does it specify the square footage, or was that your guess?
Were you billed for $1600, or the depreciated value of the carpet?

Hi I saw your thread about your attorney, who is the one you have, is the rate reasonable? I am having a big time problem after moving out of state. Thought if you go to court maybe you want to do a joint suite or I could use your attorney too for similar problems.

the apartment i moved into has this god awful dusty powder that is getting all over my brand new furniture....what can i do????

Is it coming from outside? My last place had horrible black dust, which I attributed to being near the airport - jet fuel - yuck! If so, keep the windows closed.

Otherwise, is it blowing from the heater? Change the filters?

Using the fireplace? Gunk blowing down the chimney? Stop using it, close the damper?

OP, it is almost unheard of to replace carpet and not replace the pad. Unless you have irrefutable proof that the pad was not replaced, then the pad was replaced when the new carpet was installed.

Pad and the fee for the installer are going to be over $1 a square foot. If your figures are accurate, you were charged $3.55 a square foot. So, very rough estimate, $2.55 a square foot for the carpet itself. That's probably more than I would spend for carpet in a rental, except that I haven't priced carpet for a couple of years and it has probably gone up, like everything else. $2.55 a square foot carpet is not great carpet. Ir's a very long ways from high end, and maybe it is equivalent to what was in the unit that you ruined.

The bill for the carpeting should be prorated for the life of the carpet. If it was two years old, then most of the bill is going to be yours to pay. If it was 10 years old, and in excellent condition, you will pay, but your portion will be on the small side.

I suggest that you first speak to the management and point out that they forgot to prorate the charge to you.

I also suggest that the next time you have a stain on the carpet that you hire a professional to get it out for you. He'll be a lot cheaper than replacing the carpet. A good quality carpet cleaner can also repair minor damage. I realize that doesn't help you since you are already out, but now you know for the next time.
