Hi,
I moved in to one of the society two months back. I read the contract and at that time, there was nothing mentioned about Lease Breakage clause in Contract. Unfortunately, I have to now move to different location because of my job.
When asked to Lease office, they came up with big amount and said either I pay or I keep paying rent till they find other tenant.

My questions is, how can they charge any amount, if it is not mentioned in Contract by any means.

Please suggest ASAP.

Do you have any reason to believe they will have a hard time finding a new tenant?
How much is "big amount" compared to the monthly rent?

Or do you think you should be able to break the (year?) lease without ANY repercussion at all?

What do you mean no amount is mentioned in the lease? Surely, the lease gives the monthly rent amount and also gives the end date of the lease. You owe the monthly rent amount for every month left on a lease.

Some leases have a lease breaking fee. If your lease does not, then, legally, you owe rent for every month left on the lease.

I suggest that you get busy and clean that place up spotless and get to work on finding a replacement tenant that the landlord will approve. I suggest that you do not sublet because if you sublet, you are still responsible for any and all damages and for the rent until 2 things happen. The lease expires and your sub-tenant moves out.

Until the apartment has been re-rented.

The LL will also have the responsibility of operating a continuing business to diligently
attempt to re-let. Specifically... they must do all the things they ordinarily do to get new
tenants (such as the advertising that got you to come there).

It could still take them a while to do so and especially coming into the holiday season.

Hi,
There is no clause mentioned in Contract. Also, I am ready to pay 2 month notice to my landlord. They are coming up wth 4 months extra rent. Which is no where mentioned in the lease papers. Also when asked them, how did they calculated this amount, they were unable to answer. They also agree that there is nothing written about Lease breakage consequences.

They are asking for 2 Months Notice amount + 4 month rents extra

A lease means that you are responsible for the remainder of the time until the lease is over!

BUT the LL has to mediate the damages by advertising actively and so do you and the minute they have a replacement tenant you are off the hook. In case the LL doesn't actively advertises and sabotage any reasonable potential tenant you will have a high chance to win in court!

If the LL does advertise but doesn't get a new tenant than you have to pay all the way until the end of the lease, but that hardly ever happens.
