Most of the time you have to give a written notice of your move our date even if your lease is ending or has ended by that date. Typically it is a 30 day notice. I am assuming that even if you moved out without the proper notice that the landlord is still obligated to send the proper notice within the specified time of his/her intent to keep whatever portion of the security and the reason(s) why.
Start off by reviewing your state laws and sending a certified letter requesting your deposit refund. Cite any laws applicable laws in letter but keep it peaceful and nonthreatening.

Other than collecting Attorney Fees a lease is a waste of paper, not much protection for the LL.
