Hi everyone, I am a apt. manager and I have this tenant whose lease
states that only the person or persons named on the lease are to be
living in the apt. Well she happens to have 4 guys living there and
she didn't even ask the owner if it was alright for them to stay here
this long until they get a place of their own. She also told the owner
that when they decide on the date for them to leave she will call him (owner)
and let him know. Now also one of the guys came out and talk to the owner
and told him that he is tired of listening to his (the owners) sh#t and he
wasn't going to put up with it anymore. Now I live in the city and county
of Denver, Colorado is there something we can do about this? Oh PLEASE
somebody out there help. Thanks

If they are not on the lease then the owner should be able to file a charge for trespassing on his premises.

You are the apartment manager? You should know how to enforce a lease, how to file for eviction when the tenant violates the lease, etc. If you don't, then you need to contact an attorney. A lease is a legal document that has implications for both the tenant and the landlord. There are state laws that govern both tenant's rights and the rights of landlords.

What kind of help are you looking for exactly? Dealing with situations like this should be part of your job description.

Didn't you have a rules and regulation section in your lease, stating that if any guess that stays above a # of days, acharge of (example) $10-25 per day will be charged.

Also, if your lease only has her as the occupant of that unit and she is allowing other people to stay without adding them to the lease, then she is violating the terms of her lease and you should send her a written notification giving her X amount of days to have them out or legal action will be taken. You need to look up the landlord/tenant laws of your state to find out what is the amount of days you need to allow. For example, I'm a landlord in Virginia, and we are given 30 days from the day of written notification. Please know that if they do not move out within the days you are allowed by the state, then you will need to file a notice of eviction with the court, BUT remember that if you still accept her rent payment, then the judge may end up throwing your case out, because by accepting credit, you are accepting their occupancy.

You really need to read the landlord/tenant law for your state and/or consult with an attorney.

Couldn't agree more with previous posters. If you're the apartment manager you should know such basics. The lease is clearly being violated and there's no reason for the owner or you as the manager to be engaging in any back and forth nonsense such as you describe. You simply follow the law, set the ultimatum in writing and then follow through with an eviction if they don't remedy the default.

I get the sense that the help needed is because there are two little old ladies being confronted by rough people. If they have threatened you, call the cops.
Otherwise, follow your states LL tenant laws and get an eviction started, either through an attorney on on your own. Good luck on this.

I agree. It sounds like the property manager and owner are afraid of the tenant and the tenant's "guests".
Sending a notice of a lease violation with a time limit to correct is the start. Follow the Denver laws about filing an eviction if the violation is not corrected. No more verbal communication. Make it all in writing.
