You done screwed the pooch on this one OP.

You need to talk with an attorney ASAP, you could get yourself into a world of hurt.

I suppose that you bought the home with a "First Time Homebuyer's Mortgage", you need to live in the unit for at least three years until you can rent it out. Otherwise you can be awarded hefty penalties and all sorts of uncomfortable things.

You are way beyond the help of this board, suck it up, and pay an attorney their $400-/+ for a good consult and review of your case.

I'm in the other situation, we rented a house in Del Mar and the owners asked us to LIE about our tenancy if we were inquired by any bank personnel, then the Owners made us pay the utilities to them and keep it in their name and ON TOP of all this kept their personal mail at OUR home and collected it regularly. It was a pain. The landlords started their permit process and started hiring architects and contractors to visit the home regularly, we asked them to stop and they did not. The Owners are clearly inexperienced Landlords, as they never gave us a written notice to enter in th 10+ times we discovered some person had entered our home. So we decided to move out and they are now suing us for leaving the lease 3.5 months early. I looked into our legal position and there is none, apparently banks don't care if the mortgage is getting paid, they are happy. Does anyone know any other recourse for us?

You do have a legal position, what makes you think you don't? Read up on your state laws regarding your right to the quiet enjoyment of the rental property and the landlords obigation to provide advanced notice before intruding on you in the rental property. Document in writing all of the intrusions you experienced and your complaints to the landlord regarding those. Then take it all to a real estate attorney and ask for their assistance.
