Hi everyone,
I used to share a 2 bedroom/2 bath apartment with a homemate. We paid $450 deposit upon renting the apartment (half/half). My previous roommate still lives there, but I have recently subleased (legally) my room to a lady who promised to pay me half of the deposit (since she said she cannot pay it then and promised to give me a $225 check with her next paycheck in two weeks). Unfortunately I trusted her and now not only she does not respond to my phone calls or emails, but also she has not given me back the form which she had to fill out, which states the condition of the apartment, for which she had 48 hours time to fill out as it is stated on the form (I cleaned the apartment and took photos from everywhere before leaving but I do want her to fill out that form).

Now, can I sue her for the deposit? Or, for not filling out the form which states the condition of the apartment on the date she moved in? The problem is according to the landlord company the deposit (after subtracting any possible damages) will be paid back to my homemate as a check (I am afraid that in case of any damages the lady who sublet my room might not take responsibility).
Also, considering that I signed the sublease at the leasing office before leaving the apartment, will I be responsible for any possible damages she might make which would possibly cost beyond the amount of the deposit?

I would appreciate your help.

If the sublease agreement was contingent upon her giving you a security deposit then you can go ahead and evict her as she's failed to abide by its terms.

Yes, you signed a sublease agreement but you are responsible for her adhering to all the terms and conditions of the original lease. In other words, if she causes any damages to the apartment then the landlord will come after you, not her, for restitution. Subleasing is a tricky situation to get into. Unfortunately your former roommate is also going to be stuck if the woman creates any problems since her name is presumably also on the primary lease.

Suggest you talk to someone at your local Legal Aid office to get some professional advice on how to handle this. Good luck.

My landlord I rent a room month to month verbally gave me 30 days on the first I asked for it in writing never received it I gave her a 30 day in the middle of the month and said I would honored the verbal if I can get the deposit before I move to help with moving cost she agreed and said if I give deposit back can you be out by the first even though I'm not due to vacate till the 17th she is now backing out and wants to throw me out and not pay because she spent it on personal use I have complied and repeated over when I receive I can be out in 36 hours but she won't honored her end what do I do she accepted the early deposit request and 30 days
