I was given a 20 day notice to be out of my apartment due to the landlord not picking up the rent money. He put a letter on my door stating he would come in and pick up the rent money since I refused to give him my debit/credit numbers he asked for. He didn't show up to get the rent money like he said he would and then sent me the 20 day notice to be out. I find it unfair because he's the one that said he would pick up the rent money and never did. He doesn't fix nothing in the apartment and there's not even a smoke detector in the apartment. My mom fell in the apartment last year due to the broken flooring in the bathroom and now is wheelchair bound in a nursing home all because he refuses to do the repairs he keeps sayn he would. The sewer line backs up in the not working bathroom sink. The heaters and stove don't work. I just don't know what to do or who to talk to about this stuff. In february when he gave me the 3 day notice he walked in the apartment without asking if he could come in and I didn't invite him in either. He's been getting all the other money orders and cashing them then sayn he didn't get them that's why all this stuff started. He got mad at me and told me he don't want me sending anymore money orders to him since as he says they keep getting lost so he said I have two options give him my debit card numbers or pay in cash. I agreed on paying in cash but he never showed up to get the money and never contacted me untill he sent out the 20 day notice. I need to know what the next step is and what's best to do beause I don't understand the eviction stuff.
Your lease should spell out how and when rent is to be paid or considered paid. Go by that. If it is contrary to how he wants it paid, stick with it. He might have money troubles and wants cash to avoid taxes.
And get the hell out of there if it is as bad as you say, but be ready to defend yourself in court with photos as proof. And go ahead and call the health department or code enforcement and get the ball rolling. You could be protected from retaliatory eviction by state law.
