I am currently renting an apartment in Georgia and am under contract for a house. Back in April I informed my landlord and asked about going month to month until we close, I planned for only adding half a month to the lease, so paying for all of July instead of 1/2 (lease ends July 15th). The answer I got was as long as there are open units for rent. I keep checking in every month to make sure we are still ok for the plan ahead. I hear nothing until today 6/28, 3 days before rent is due. I am informed that my unit was leased and I have to be out in 17 days. I have emails confirming the month to month plan and that she promises to keep me informed if she is close to leasing all the units. I was not kept updated and was blindsided by this today.

Start packing.

You were not told that you could stay. It was "maybe, but only if". Your lease is up, you didn't get the extension in writing.

You've got 2 weeks until your house closes. Rent a storage unit and move into a long stay motel, if you don't have friends or family that will put you up for 2 weeks.

Does your lease say anything about how much notice your LL has to give you?

As long as we still have 2 bedrooms available for rent for the August 1st
move-ins, it will be fine for you to renew your lease monthly. IF we rent
all available 2 bedrooms and yours is the last - another option for you
... you could move into a 3 bedroom that rents for $750 .... I'm just
saying that is an option ....

I have noted your situation - and I promise as time approaches and/or I
get close to renting all available 2 bedrooms, I will give you a heads
up!!

This is what I have in an email from LL, which was sent May 3rd. I checked in verbally when I dropped of rent in June and she said we were still ok with this plan. I have heard nothing since then. We were told we could rent month to month if the unit wasn't rented. Where do you draw the line as far as notice goes. There was no heads up or anything to tell us otherwise until now. What if they rented in July 13th? Could they say get out you have 2 days?

No, says we have to give 30 days if we wish to terminate.

The bottom line is that your lease is ending, and it wasn't renewed.

As the other poster asked, what does the lease say about notice regarding renewing lease or going month-to-month? Unless there's something in the lease giving you more notice, your lease just simply ends, in my opinion.

I know it's inconvenient, but it sounds like you are in a bldg where students rent. I am, too, and there's a tight window of time to nab the incoming students, so I understand your landlord's situation. Sounds like she tried to work with you, but she's got to get those incoming leases signed, too.

This Lease Agreement shall terminate at noon on the date stated in Section 2. No automatic extension or renewal exists with this document.

Well, there you have it. Bummer.

Looks like you should look into putting everything into a truck and/or pod, and checking into an extended stay hotel.
