My roommate moved in, never paid security deposit, hasn't paid for any of the agreed upon items except half the rent, has no lease, etc, and is trashing the place. It smells like urine. Am I within my rights to give my roommate 30 days notice? I had a lease and it expired and all utilities are in my name.

Yes. Next time around do a better job, have a simple rental agreement signed and never let anyone in without collecting upfront money first.

Some states have laws establishing tenancy based on the fact that someone has lived there more than xx days. I believe this generally falls under the assumption that if you didn't want them there, you would have kicked them out after several days. Unfortunately I can't remember which states these are.

Still, kick him out. Personally I wouldn't even give a 30-day notice, but do whatever you feel you have to do to get him out.
