my family (my parent, grandmother and 2 cousins) live in this 2 bedroom apartment for two years. This apartment is around 1000sq foot. Today super told me that there are too many people live in apartment. However, he refused to say how many people could live in two bedroom apartment legally. this apartment is around 1000sq foot. He asked me to make a list about everyone in this apartment before he tell me how many people need to leave. What should I do? Also, he said we earn money from people live in this apartment. How can I prove they are my cousin?

I found the occupancy laws here:

NYC Rent Guidelines Board

Basically, you need 80 square feet per person. You can count the square feet of the kitchen, but not the halls, foyers and bathrooms.

Then it goes on to say that people can't actually sleep in the kitchen, even though you can count that space to figure how many occupants can live there, which I thought was weird.

Anyway, there are other restrictions, so read the law on occupancy and prohibited occupants in the link above. You can actually add children to the above total, depending.

It also says that you can rent to boarders - but read the section. I didn't read it closely, but it looks like there's a limit.

It does say that the landlord can ask you to give him a list of who is occupying the place, so yes, you will have to provide this.

As far as square footage, it would appear you are okay. For 6 adults, at 80 square feet each, you would only need 480 square feet of "livable floor area."

Wow!

Yeah.. What does your lease say? It doesn't matter what you or he consider too many.

I personally think it is way too many people living in your apartment.
if I was a tenant in your building, I would make all the necessary calls to have this situation taken care of.

I would not like it at all if it were in my building.

No one should be living in the apartment who is not on the lease. Are there people living in your apartment who are not on the lease?
