My husband and I recently signed a year long lease and we want out. Our downstairs neighbors are ridiculously loud. They blare their music so loud that is shakes our floor and scream and holler loud enough for us to hear every word. We have asked them nicely to turn it down because they were waking our 1 year old, but they just laugh and shut the door in our faces. We have called the cops four times in the past two months. They blare the music from five pm to five am. Twelve hours of their crap. We have told the management company of where we live and they aren't doing anything about it.

My husband works over 80 hours a week and needs all the sleep he can get and we are all getting, maybe four hours of sleep a night? The neighbors don't shut off the music until we call the cops and then they act like we are vicious people and the next night the music is even louder. Our walls may be thin, but this is way out of line and we have tried really hard to be nice. They don't even open the door for us to politely ask for them to turn down the music. They last time they did actually open the door, they had the gall to attempt to complain about our child who ends up crying during their parties and 'bothering' them because they wake her up and then they tried to bribe us with alcohol to get us to leave them alone to do whatever they want. We cannot live like this any longer. I need advice!

I am sorry this is happening to your family. Does your rental contract have a clause that allows you to break the year lease (pay a one-two month rent penalty)? That may be worth it.

This isn't of much help to you now but is a reminder to renters to check out the prospective residence more than once and at different times of the day as there's often a big disparity in the noise factor at different hours. As suggested, look at your lease to see if it has an early termination clause. It'll cost you a month or two's rent but will probably be worth it. If your lease doesn't have such a clause, speak to your LL and try and work out a similar compromise. Good luck.

When you talked to your landlord about the noise what did they say?

Your first step is to talk to the landlord, don't confront your neighbors. It only makes you angrier at the situation. Getting into a screaming match with your neighbor isn't your goal, quite is.

Call your local police dept and ask them what your city's policy is on noise like that. Our is quite strict...they will give one warning and then it moves up to a fine for the tenant and if it continues both tenant and landlord (or complex) will receive a fine.

Yes, moving is always an option, but you could end up dealing with the same situation when you move. So, talk to your landlord, talk the police and keep us updated. Good luck

Apartments are noisy places. People who need quiet should not attempt to live in an apartment building.

However, check your lease and see if there is a clause about buying your way out of the lease. If so, then pay up and move out.

In the meantime, keep calling the police and complain to the landlord, in writing.

When you move out, do not move into another apartment building. Move into a free standing house without close neighbors.

If the noise is indeed as severe as you describe, I would say your neighbors need to be Noticed for lease violation from the management company. Our leases clearly state that they are not to disturb others (briefly paraphrased). Many municipalities do have hours where excessive noise is also a violation of an ordinance so I'd keep calling the police after 11:00 p.m. every time it happens.

All this failing, I would send a certified letter to your management company asking to be released from your lease by a certain date, and move on. It's too bad people have to have laws and rules to ensure common courtesy but there's plenty of them around.

What state are you in?

You can possibly break your lease because of the breach of quiet enjoyment of your property. If you've complained, and they've done nothing, you probably have a case and can move out.

Moving out is expensive and a pain, so I hope you can get the landlord to get rid of the problem tenants, instead of you.

I think you should tell management this is the option they face. Getting rid of you or the offending tenants, and that you will sue if necessary.

Thanks for all the advice. We are renting out a condo, so our landlord only owns the unit we are in. They contacted the management company, but so far nothing has changed. We are attempting to negotiate leaving with our landlord because this is way too much. We've lived in plenty of apartments before and have never had the problem we had now. Sure, there was some noise, like people walking and what not. Expected things, but nothing like this. Hopefully we will be able to get out since clearly the management company will not do anything about these rude tenants below us.

Does this condo have an HOA? That's where you get them, have your landlord file a complaint with the HOA ( normally HOAs wont' deal with tenants, they will fine the hell out of them, but won't talk to them )

Have you called the police yet? If not, do so. And ask about any noise ordinances.

Write a letter to the management company (send it RRC) outlining the issues you're having with their tenant, make it clear that each and every time this type of behavior goes on, you will call the police. Your landlord should also being sending their own letter because if it's bad enough, he's losing income and can sue.

Trust me, after coming out and dealing with this crap a few times, the police will contact the company and the owner.

If your landlord doesn't own the noisy unit, find out who does and start sending your letters of complaint to the owner of that unit. He might not know what is going on.

However since it is difficult to evict anyone for noise, don't expect their landlord to be able to do much about it.
