The reason we settled is because it was emotionally exhausting and I didn't want to go through two more court hearings which is what the mediator said it might take if we didnt settle. Also, I never said that that I "would be able" to get double the deposit, I merely said I requested double the deposit in my filing. I did this because it is legal to do so in WI and I had undergone additional crap from this landlord emotionally due to their behavior, and also because I thought the landlord would be less likely to pull this on another renter if the judge were punitive. And, BTW, I NEVER said things were "cut and dried."

OP - Glad you got things resolved. I think your experience with them ordering you to arbitration right away is interesting. My case also went to arbitration, but that was after two attempts at getting things resolved in the courtroom and it was entirely optional. If either one of us didn't like how it was going we could have ended it right away and taken it back to court. Fortunately, it didn't come to that. My case was in Kenosha County. Did your LL file a counterclaim on the damages to his car? You probably could have gotten more in arbitration by holding out, but I know from experience that there's something to be said for just getting it over with and moving on.

I wish it had been that way for me. The mediator said it would likely take two more hearings or more to resolve it all. 1 for judge to look initially at my suit 2 for judge to look at the countersuit they said they would file (probably bluffing but who knows?) and 3 for the judge to "get more information if necessary".

So we settled. I couldn't stand the emotional stress of going any further and I just wanted to put it behind me. I was so fed up with these condescending jerks. I feel so much better now. There is alot to be said for getting stuff behind you.

landlords seemingly wont return a deposit no matter what.

they think no one will take then to small claims court let alone sue them for more than that.


the rules seem to be in place to help ONLY them and not the tenants.

im currently in the middle of tracking down my previous landlord so i can get my deposit back.

I hear you. Fortunately this is the first landlord for me that didnt return my deposit. He bought this property needing major repairs, now cant rent it until the repairs are made, and wanted to keep my deposit to help him during the gap. I will NEVER rent from a private party again.
