im going to be putting together a 6 monthy lease for my tenatns , there 1 year is expired and we came to an agrement that they can stay . i was going to refuse to renew their lease. I don't like some of the people that are on the property from time to time. I want to know if i can put in the lease no felions are allowed on the property at any time. this will apply to only guest and visitors. I am not going to hold my renters past mistake against them and having a feliony myself from 1986 i understand 1 strike dosnt mean your not worht a second chance . As far as visitors or guest they have no vested intrest and i have no reason to give them an opertunity . Can i do this and is it legal in the state of ca??? thanks
The tenant is responsible for the actions of any friends, relatives or guests who are visiting or living in the
rental unit. This would include any damages or violations of the rules/policies.
I agree. Not something you can stipulate. If you don't have a similar clause already in your lease then you can present a new lease to your tenants with that stipulation included. Otherwise their current lease, upon expiration, continues as a month to month with the same terms and conditions as in the present lease. This might be your best bet as then you can give them notice as required under CA law (I believe it's 60 days?) without having to give any reason at all. Check CA landlord tenant laws which you'll find linked in the first "sticky" on this forum.
Right now is the start of moving season.. If you give them 6 months, the lease ends right at the start of holiday season when nobody is moving and vacancies sit empty, sometimes for months.
If they are problem tenants, get rid of them now, when it is a good time to replace them.

Almost certainly not. Even if it were possible in theory, in practice it would be damn near impossible to enforce.
