Hello

I had a roommate a few summers ago that I found in craigslist. She only needed a place to stay for a month for a summer school class. She had a dog and asked if it was ok that she bring him. I said yes as lo as he was potty trained and that she would have to take care of the pet deposit and what not. We'll she never paid it ( she ended up only staying like three weeks). We'll she had puppy pee pads for him... I was constantly gone at work or in my architecture studio... I would come home and the dog would have peed all over. If the dog peed "close" to the pee pad she would applaud him because he almost got it. She would neglect cleaning up pee spots when they happened out of laziness causing stains. It became a problem then moved out suddenly on bad terms. Wouldn't respond when I contacted her... I had to pay hundreds of dollars to get the carpets cleaned. And now the apartment complex sent me to collections for 1,100 plus didn't give my deposit back for replacement of the carpet. She tells me "good luck finding her or contacting her" and that she's not paying for it.. And now I am having trouble leasing anywhere else without paying this fine.

Can I take her to small claims court for destruction of my property and neglect to care for my property while staying under my roof? She didn't sign a lease since she was only staying a month. (My biggest mistake)

HELP! Any thoughts would help. Thanks

Hi - I'm so sorry you went thru this valuable lesson. i keep hearing about people using Craigslist and getting a bad deal. and also you not having her sign a lease. doesn't sound like you can even find her. nothing is in writing, right? its your word against hers right?

your name is on the lease right? so your landlord is going to hold you responsible.

I am sorry I dont have any ideas for you, but only for next time, you have learned a valuable lesson in what not to do for next time.

No point getting your own name trashed because of her irresponsibility so pay the bill.

It's not important that you don't have a signed agreement with her as long as you have emails, texts, anything to document that she did in fact stay with you. Do you have any photos at all of the dog, the carpet pre and post, witnesses? I assume you have all the documentation from the LL about all the incurred expenses.

Finding someone isn't impossible and once you have an address for her you can file against her in Small Claims court for reimbursement. If she's served but doesn't show up you'll automatically win your case and if she does show up you need all your proof to assert your claim.

BUT, get that bill paid. Good luck!
