I moved out of my apartment this weekend. (Everything was paid off, lease was up and due to the huge increase in rent, decided not to renew my lease). I was responsible for my electric bill. I had the electric company shut off the service (since it's my name ) today. (sent the request last wk)

Apartment manager just called me and said I needed to keep it on until the new tenant moves in (next mth) & I will get fined for shutting it off without notice.. She told me after they check my apartment, they would send me a list of anything I might need to pay off that the deposit isnt going to cover which will also include this fine (apparently, my deposit wont cover the fine for shutting off the electricity)

Doesnt make sense to me, is this normal?

No, it absolutely is not normal. IF all the terms of your lease were fulfilled and you handed the property back to your LL, it's the LL's responsibility to maintain service. Many landlords who have properties where the tenant is responsible for putting the power in their own name have an agreement with the electric company who, instead of shutting off service, put it into the LL's name until the next tenant signs a lease.

Check your lease carefully to make sure that there's no stipulation in it addressing the issue. If there's not, you can then advise the manager accordingly and when the LL/manager sends you the security deposit accounting in accordance with state law and this "fine" is wrongfully included as a deduction, dispute it in writing.

Thank you! I checked my lease and it didnt add up. I am going by at lunch to see whats going on.

The only exception is if your lease was through the end of October, and you moved out early. It is entirely possible that your lease may say you need to have utilities in your name for the duration of your lease (ie through the end of the month). Possibly continue maintaining the yard, too, if applicable.

I don't make my tenants do that, but I could see there being a case there if the lease said it.

Unfortunately becoming Normal, but still wrong.

The last two apartment I have used have tried this.

I told them that once I am out of the apartment I am no longer responsible for anything and they can take me to court of they want to try to enforce it. The last one in Charlotte told me that even though my lease was up Oct 7, I would be responsible until the new tenant moved in on the 17th. (Meanwhile the apartment complex staff comes in to paint and clean - etc using the utilities.) I told them that wasn't going to happen.

I received my full balance security back days later.
