I know that many tenants who have issues paying also have issues opening envelopes. The OP is not denying that she had financial issues so there seems to be some truth to the case which makes me a little skeptical about the rest even though the tenant may have some truth to her/his side it will need to be proven in court of law for both sides.

Not showing up on her/his credit report is not strange since it just happened and there may not be a final judgment and/or collections started on the amount but over here the minute I leave the court house the paper is entered into the system and the public records show the eviction case and YES it will matter if you apply for your next rental place unless you go through an owner who doesn't check.

I understand that.


My concern is that they filed for $877 plus fees when I really only owed the $102 on the date they filed.

Unfortunately this is all happening in Baltimore City, the land of "not doing anything correctly." I've searched the District Courts of Maryland's website, and nothing is showing up under my name. Not even for the case where I DID appear. I searched under the property management company name as well as the name of the complex....nothing under my name. I did see of number of other tenants, but not me. I had my first case at the end of November, it should be public record by now.

This is all very strange to me. But I will be filing a Motion to re-schedule my date. I will ask my LL in front of the judge why the amounts differ, and I will also question why my summons was not mailed for nearly a month. It wasn't that they mailed it and it got caught up in the holiday mail traffic, they simply didn't mail it until they felt like it, I guess.

Sounds like you can clear things up at your new court date.

As far as an eviction showing up on your report - where an eviction shows up, is in an eviction report - not on a credit report. They are different beasts.

A credit report will only show any of this, if the landlord actually got a judgment against you. Judgments will show up on a credit report. You may get lucky and it may not ever show up, but my point is that credit reports show your credit history, and any judgments or bankruptcies - things having to do with your financial picture.

An eviction report, scans court records for eviction filings. Just the fact that an eviction action (such as an unlawful detainer) is filed with a court, is all that is required for these eviction report databases. Even if you win an eviction case, it doesn't matter. These databases normally just list the names of tenants who have had eviction actions filed against them in court.

So, if a future landlord pays for a separate eviction report, you may be listed as a tenant who has had a landlord file an eviction action against you.

You may fall through the cracks, and not get listed on one. But, once you're on one of these lists, it will haunt you probably forever, as it's public court records. Not all landlords spend the money on an eviction report, though, so it's not impossible that you'd find another rental.

You are making this way too difficult. You need to request a new court date. Take your proof of what was owed in November at your last appearance, proof of what you paid since that appearance and the letter of the court date you missed, showing the date stamped for delivery was after the court date. As long as you have documentation of what was owed, what you paid, and why you missed your last court appearance, it can all be resolved fairly easily.
