That would be up to the landlord. The landlord can raise the rent or simply not allow the new spouse to move in.

She needs to find other housing where it is not illegal for her to live there. That is no one's problem but hers. Crime = Consequences.

Probably not, but the new spouse doesn't get to move in without submitting an application and being screened and approved. If the new spouse can't pass the screening, the newly married couple gets to find a new place to live.

A new child, on the other hand, is covered by familial status in the Fair Housing laws. If that new born child has a felony on his record, I will give the family notice to move out. But it is because of the felony, not the child being added.

Don't childless adults have familial status = childless? Saying childless adults don't have familial status is like saying single people don't have marital status.

What if a family with a convicted teen applies?

Why should they get to move penalty free? The applicant has been denied, not the current tenant. If the current tenant needs to break their lease, they need to follow the early termination clause just like everyone else. The landlord might be willing to work with them, but they don't have to.

Remember...the applicant already knows what the landlord is going to check out so a denial/approval shouldn't be a surprise.

How old is the teen? 19, with a criminal record? Denied. 17, with a criminal record that's sealed? Approved.

There are cases where a child under 18 doesn't have a sealed criminal record and it doesn't really matter to the landlord because they are probably already sitting in jail....and will be for a while.

Landlords do not take applications on children under 18 nor do they run credit/background checks on them.

If a landlord said he wouldn't take an applicant BECAUSE they don't have a child or children that could be argued as discrimination. Raising rent because of additional wear and tear due to additional occupants is somewhat normal.

As far as going back to jail because of no residence....that's not the landlord's problem. However, the OP could wind up having it be his problem when he gets evicted. Fair or not, the OP entered into a contract and has violated that contract by allowing someone else to move in without being approved.

A childless couple does have a family status, however under fair housing laws, "familial status" only applies to children. So from a legal point of view, under the law as it pertains to renting, a couple without children does not have familial status.

Married, unmarried, same sex married or unmarried couple, they might have some rights pertaining to renting, but it is not under the familial status clause of the law if they are childless.

I can't run a background check on a child under 18. I do, however speak to the current and prior landlord and ask if there has been any trouble caused by my applicants. If I am told the police were there and arrested the child for drug dealing or vandaliasm, or that the child did damage to the property, I will reject the application on the grounds of a bad landlord reference, not that the child has a criminal record, because I can not access the criminal record of a minor.
