We are living in a shared house in Virginia. Our lease ends at the end of the month and we have yet to receive a lease renewal or a notice to leave from the LL. We have been here a year. We all want to stay. The lease says that we have to give 30 days notice if we want to leave but no such provision for the LL. I have tried to find the law but have found conflicting things online.
What are our options and what does VA law say about this situation? Our LL actually is laid up w/a broken hip and her daughter is taking care of the rentals. We assume she just doesn't realise that the lease is nearly up.

Call the landlord, not the daughter. Tell the LL you want to stay and you'll be putting that request in writing. You need to decide if you want to go month to month or sign another annual lease. In the end, it's the ll who makes that decision, but let her know what your wishes are.

What did the daughter say? You mentioned she is taking care of the rentals.

Mom has to give the DD Power of A. before anything she says or does is Legal. Write a note to the LL Make sure you get a signed Reciept. DD can sign for it that's your proof you mailed it. Just tell her you want to stay & re-new the lease. When would it be convient to stop by & get it signed. I bet all she needs if a Friendly reminder! I remember being layed u in VA Hospital 2 weeks with a broken arm Believe me I dint think of much else except my animals & I lots of friends helping & reporting to me 2 vets & animal control too!! Anyway the Pain is so bad then the give you pain meds all you want to do is Sleep!

A POA is not required to act as the mothers agent/representative of the property.

The VRLTA can seem confusing but you need to first read and understand the terms of the lease. The lease should outline the tenancy you have. It will say that the lease starts on X date and ends on Y date. You need to write the exact wording for us to read since they could leave it open to extension via month to month, or it can be written that your lease absolutely ends on Z date with no rights to remain. In such case, the landlord has no need to provide any notice in advance because the lease is the notice. Also, there could be a provision in your lease that discusses lease end and holdover which will describes what if anything will happen once the lease terminates. The VRTLA will help you understand some parts of the law but the lease is the FIRST place you look for terms and conditions.

I thought that Virginia requires a license to engage in the renting or leasing of residential property unless you are the actual property owner of record. The daughter will need to have power to act as the owner of the property otherwise she would need a license. Am I missing something?
