I live in an apartment in Ohio, I've lived here since last march. My 1yr lease was up this march. The lease states it renews on a month by month basis after the initial 1yr. I am planning on moving soon. My question is my lease says I must give a 60day notice prior to moving out but I am only renewing my lease month by month can I really be forced into giving 60 day notice? Or can I just refuse to resign a new lease?
It depends on the specific wording of the lease, but in general, I would say that the lease is still valid, the expiration date just moves one month out every month. All the other terms are still in place. So if your lease says 60 days notice, 60 days notice is most likely what is required.
When your lease rolls over to a month to month it does so under the same terms and conditions as in the original lease so, yes, you have to give the 60 days notice. You're already on a month to month since your lease expired so why would you sign a new lease if you're thinking of moving soon?
