Boyfriend just handed me "ALL" the key's to our Townhouse, they are currently in my hand's.

AND He's on the Lease.

Can he be taken off the Lease without being told and what if he can NOT be found?

He cannot be removed without his signature. If you can't find him to get him removed then you wait for the renewal and have your landlord remove him then.

You can also sue him in small claims court for his share of the rent. That can be very useful if he ever shows up and starts demanding anything. Because, once you have a judgment, you have years to enforce it. For example, suppose he claims he left something valuable behind, and tries to threaten or sue you. Then you can counter-threaten him, that you will garnish his wages and bank account, if he doesn't leave you alone.

AZ is correct. You're going to have to leave him on the lease until renewal. here's the thing..until the lease expires he's still responsible for that unit as if he lives there. He can't just walk away and call it a day.


The real question is: Can you afford this unit on your own? If you can, keep on living there. If you can't, you need to take action sooner than later. If, God forbid, you get evicted....he also gets evicted because his name is on the lease.

This. And call the landlord to change the locks (at your expense ).

Some questions that are important to any really helpful response:

*Does the Landlord know you live there?
*Can you afford to pay the rent on your own?
*Do you want to keep living there?
*Is there any damage to the townhouse caused by you guys?
*Does the townhouse need any repairs?
*Assuming you are living there with LL approval, are you in violation of any rules (example: do you have an unauthorized pet; do you smoke in the unit; have any walls been painted without permission, etc.)

These issues need to be known before you can really come up with a plan....

Inform the LL that he has left. If you cannot pay the rent, ask the LL if he will let you out of the lease early. Offer to keep the place spotless and neat, and allow him to bring by any potential tenants to look at the unit whenever he wants. Make plans to move.

If he won't let you out of the lease, ask if you can get a roommate, since you can't afford the rent on your own.
