The only way I can see this being extended out is if the tenant pays at the court house. If that's the case you can't evict him anymore and you're going to need to serve a 30 day notice to vacate saying that because he's been absurdly late that is a breach of contract and he has to move at the end of the month. If it comes to that you can have a friend file the POTENTIAL eviction if the tenant doesn't vacate at the end of October.

I have seen more than a few of these. You pretty much have a Slam dunk. The Judge is almost never nice to the tenant in these courts in NV. Virtually always a quick win for the LL.

There is a tiny chance you could run into a Judge feeling super tenant friendly but I have never seen that happen. Normally the only out for a tenant is to put up the money owed then and there. Otherwise out. And they generally cannot even get other stuff discussed.

So sleep tight. It will work out.

This is nothing to be proud about, quite opposite, this is just one more reason why Las Vegas is a not good place to live.

If you're a dead beat tenant Nevada in general is not a good place, we have quick evictions here.

No because the courts (as you said) are always nice to LL and never nice to tenants. You even call for a Slam Dunk. What that means....kick that family, kick those kids on the street. And your posts continue to show your lack of understanding. In NV if you don't pay your rent you get evicted. But if you do pay your rent the system is very supportive and friendly.

It is a little weird in a way. If you are not going to pay the rent...you should live in CA. But if you do pay your rent and the LL gives you trouble you are probably better off in NV.

So who do you favor? The family with lots of kids who pay their rent...or the family with lots of kids who don't? And then which LL do you want screwed...those with lots of kids or those with lots of kids.

Then move to a country that has more social programs or stop voting republican. But you're not going to live off the blood and sweat of other people that worked hard their entire life to scrape together a down payment to purchase a rental property.

Legal hardship is not a defense. A rental is a for profit business, not a charity.

As far as the kids go, the first thing the parents should do is keep a roof over their head yet many parents choose to spend their cash on cigarettes,booze, and worse. Not to say this is the situation here, but likely the parents made bad choices.

There are plenty of places the tenant could have gotten assistance from but chose not to. Assistance includes moving to a place they could afford.

What will happen here is that if by some miracle the tenant comes up with the money this month they will be right back in the same situation next month.

Unfortunately, sadly, I can almost guarantee you that the unit in question will be trashed with significant repairs needed. Not from Landlord neglect but tenant neglect and outright damage. The landlord is somewhat at fault for not doing a background check on the prospective tenant. I doubt this is the tenant's first dance. A background check would very likely found other eviction court proceedings or small claims judgments and or criminal convictions.

It also doesn't sound like the landlord obtained a security deposit although I could be wrong. Additionally in the application, the landlord should insure that the tenant earn enough that only roughly 1/3 of their income goes to rent especially with children.
