Boyfriend and girlfriend rent the house in NC by both signing the contract, and two keys were given the girlfriend. Boyfriend calls the landlord and says she does not give one of the key to him. Girlfriend calls landlord and ask to remove boyfriend from the contract. What should LL do?

If both individuals signed the rental agreement, both are equally responsible. The landlord CAN NOT remove one party without both signers (and the landlord) consenting to be removed. If they both agree to be removed, a new agreement or an addendum needs to be completed and signed by all reflecting the change.

If it was me, I'd send the girlfriend an email (in writing is my point) asking if there is any domestic violence with the BF. In CA, anyway, this is a valid reason to break the lease.

If she says no, they're just breaking up, then tell her that they will have to work out any problems. It's up to you if you want to offer to let them out of the lease. But, they'll both have to agree, and be sure and put it in writing. And if they don't have a valid reason to get out of the lease, they're both liable for rent.

Also, if no domestic violence issues, then give the BF a key.

If she claims domestic violence, you should read up on the laws on that. If the laws allow, you might want to ask her for a police report.

But, honestly, I'd try to get them both to just agree to terminate the agreement and look for another tenant.

What kind of contract and which one of them is the one with income?

Careful with that advice. In some states and cities it has been ruled illegal to refuse housing to unmarried couples.

Agree that renting to married couples is no safer than those dating. Might actually get uglier!

The landlord has no obligation to give a key to each of the occupying people. The bf and gf rented the entire unit, not individual rooms, so giving a key to one is the same as giving a key to each. So the landlord did nothing wrong there.


If the gf is wanting to stay, and can qualify on her own, and the boyfriend is willing to sign off on being removed from the lease, that can be done. Or if the gf is wanting to move also, they can discuss breaking the lease. But if the gf doesn't qualify on her own or if the bf doesn't want to sign off, then the landlord's best move is to do nothing, and leave the existing lease in place.
