The apartments I live in had a change in ownership at the beginning of the year. Since then, they have cut down all of the trees, closed the gym, stopped accepting packages, had multiple gas, water, and power outages, and are entering our apartments on a weekly basis. I have also been sexually harassed by several of the contracted painters and tree trimmers.

I have brought all of these complaints to the new management company and requested that they waive the $2000 early termination fee since they cut amenities, my electric bill has increased from having to run my a/c from lack of shade now that the trees are gone, and I no longer feel safe as they are allowing the men who make sexual comments and gestures towards me to enter my apartment to remodel and paint my balconies. They stated that they cannot waive the fee because the contract is with the previous management, not them. They stated that it would be illegal to waive the fee. Is this true?

When the New owners took over last year they Waived ALL fees & returned deposits for any one that wanted to move before the end of lease. So Yep you are being LIED to!

The new owners simply assume the current leases. They are not required to waive any fees or return deposits.

They have no legal reason to waive the fee. If op believes she should not be charged a fee, she is free to take the landlord to court to have the lease voided without penalty.

The OP should take them to Court for Sexual Harassment ... not much she can do about the other changes. & the may rule she gets the Fees waived so she can move to a safer place.

Discrimination.

That is the biggest legal reason to not waive any fees. Don't get me wrong the OP is still being lied to but there is a good reason to not do it. Once they do it for you they must do it for everyone or risk being sued for discrimination. Maybe the person the OP spoke with didn't understand what they were told or communicate it to the OP very well.

While it is not illegal to waive fees, there is no reason for the landlord to do so. You want out, OP, pay your early lease termination fee just like everyone else does and move out.

It would be a violation of fair housing laws to treat you differently from the other tenants. If the others don't get fees waived, neither do you. So there is that aspect of legality.

When does your lease expire? At least the guys that are painting will be done pretty soon, right?

What does your lease say about the gym? Did they temporarily close it as part of their remodeling process, or did they permanently close it?

I bet the power/gas outages are temporary and related the the remodel activities too.
