Tenant and landlord agreed on a contract for two years and rent amount, after first year landlord wants to increase the rent for second year, can LL really do this? What options does tenant have? This is in NC.
A contract is a contract. If you both signed it and it states that the rent is x amount for the 2 year period from x date to x date and it states nothing about LL having the option to increase the rent during that 2 year period then they can't increase it because you are locked into the terms of that lease contract, period.
If LLs were able to increase the rent whenever they wanted to during a signed lease term with a set amount stated for rent we would be in a boatload of trouble! Plus, it would contradict the reasons for even having a signed lease contract.
This is exactly where LLs get themselves in trouble by committing to anything longer than a year lease. So the LL is just going to have to suck it up and live with it until the lease term ends.
"Contract?" Do you mean Lease? A lease is a contract so I guess I'm being pedantic.
But if you have a document that you both signed where you agree to lease the place for 2 years for a specific rent, he can't raise the rent on you in the middle of the term.
It is going to depend upon what your contract says. Generally, neither of you can change the terms, but if you, the tenant, has made substantial changes of some sort, then maybe the landlord can also make changes.
