He very well could.

According to the link Mathjak provided:

Roommates who are not in a family relationship with the prime tenant do not have succession rights, nor do subletters (legal or illegal), nor family members who are not living with the prime tenant.

You best be moving in soon.

Well that's the problem - I read that and it said if he can establish a family relationship like taking care of my brother or mom then he could get succession rights - My brother had limited use of his hands and was able to use an ipad - he set up some special notifier so if my brother needed him he'd get it instantly...I know this because I visited after work but he left work and was already there then headed back...and I'm worried he has that email or several still - I don't think he could use them in court tho.

Thing is - I don't think he's even aware of succession rights - I'd like to get him out before he finds out - I don't live there but the cable bill is in my name even though he pays it...I made sure of that

HE IS NOT FAMILY and he's acting like he is....like a sense of entitlement. And as I said the cable bill that gets sent to that address is in my name.

I'm not looking to get ridiculed I am trying to find a solution - My mom isn't well and she gets worse every day - before she passes I want him out. Again he isn't on the lease, he simply has rented a room from my mom for 4 years. I would have helped my brother myself but he didn't even like me...my hands were tied.

Sorry to hear that. FIL was taken by ALS as well.

It really sounds like you or another family member would have to be living with your mom in order to claim succession.
