Hello everyone,

I am in the state of California. Currently relocating for work for about 3 months then returning to my current apartment.

Question... I am considering subletting the place for that period of time as I can't afford two different rents. If this is the case and I do sublease, which would be a breach of contract with my lease agreement:

1) If the management company finds out... will I receive a 3 day notice to cure or quit OR a 3 day notice to quit without option to cure

2) If it is the former 3 day to cure or quit, If I cure (aka get the subleasing party out of the property) would I be ok to continue with me lease? If I decide to "quit" and leave the premises within the 3 day period would I be subject to legal action given I am up to date with my rent and even willing to pay any termination fees OR find a new tenant to take over lease?

3) If it is a 3 day notice to quit without the option to cure, what would happen If I were to quit and leave within the 3 day period? Same scenario, rent up to date and willing to pay termination fees OR find a new tenant to take over lease? Still subject to legal action?

All in all I NEED to financially sublet the place, and I just want to know the different scenarios that can happen if management where to find out. I guess I am willing to take the risk as long as I avoid an eviction and i guess "quit" on good terms and pay fees associated with termination OR find someone to take over.

Whatever your landlord doesn't agree to.

That's the first step in the eviction process.

Find some other way to cover your bills.

If you don't have the money to even cover the lease payments, what are you going to do if your tenant trashes the place and skips paying rent? There's no judgement here, just pointing out that you could be making a bad situation much worse by subleasing.

Keep in mind, there is a small subset of tenants that prey on inexperienced landlords- which, you'll be a landlord if you sublease.

You haven't even considered worst case here. What are you going to do when the replacement decides to not pay rent AND not leave? You will end up with an eviction which will ruin your chances of renting in any decent place for a very long time as well as hurt your credit. You are begging for trouble here don't do it; you can't trust anyone in this world that you aren't related to and even then.

Before the peanut gallery chimes in I trust my wife and no one else not even my father. After 11 years of marriage spending 24 hours a day 7 days a week side by side that trust has been earned.
