Yes. I’m certain those dents were in the door at the time of move in and yes, it is marked as such on the checklist sheet. However, I do not have the photos I took of them unfortunately.

Way too much power and they have been getting away with it for too long. HOA’s do serve a purpose, but I think they overreach and should have limits.

Actually the relationship should be between board and owner.

When the board doesn't have an owner's address they could contact the tenant and the tenant can forward on the correspondence. However, they should not rely on the friendly list of neighbors names but rather on a list of owners.

People just don't know how to act sometimes.

Board members have scared tenants, children/family of owners who are doing their best and really don't need to be bothered. But if all the board is trying to do is reach an owner....you can nicely pass on the correspondence.

I have let HOA Board members know if they have a problem about my home, contact me the owner and leave my tenant alone. A tenant would be my business. Say, if he's making a lot of noise, parties, lots of beat up vehicles in the driveway...sure, I'd like to know such things although I've never had much of a problem with a tenant.

Wondering if this is a new board different than the one you had...sort of ego "showing their stuff."

Maybe. Back in March we got a ton of rain and so came the weeds. Weeds started to grow and I sprayed them heavily with herbicide. The very next day the HOA sent a letter saying I had 48 hours to remove the weeds. It’s crazy because there were literally three or four weeds that grew anywhere from 2” to 6”. I could understand if my front yard had dozens but no. They came down on me for 3-4 weeds. Meanwhile the community areas, that are maintained by the HOA, has knee high weeds, parks with grass that is growing uncontrolled and trees that were badly in need of trimming. These conditions stayed like this for months. We had a storm come in and uprooted many of the trees. I bet those trees would have been fine had the HOA trimmed them.

You might get with your home's owner on this. The board appears to be picking on his home for some reason. Some HOAs don't like tenants. Many HOA board members do like power. I have to say I know people who don't feel they have achieved what they felt they should have in life and become board members and feel finally in some sort of control. I'm thinking of a couple of boards that granted favors among each other, mailed out threatening letters over small things. I hope your home's owner is supportive of you.

Well unfortunately the home owner lives in another country and there really isn’t a way to contact him.

This is not about HOA's! Substitute HOA for City Code Enforcement, or Building inspector, or..........

Now, the issue is you received a violation notice that needs to be addressed. The issue is the responsibility of the landlord. So send it to the landlord and be done with it. Now if you are claiming the landlord can't be reached, I bet you haven't done anything to get the information. Where do you send your rent payments? Whose listed as as the responsible party with the real estate taxing authority? But most of all and by far the easiest is what does it list in the lease for sending notices?

Now, if you're saying there is nothing listed for the landlord or agent in the USA, well that's your fault for not demanding a valid address for notices when you first leased the property. Afterall, it's required BY LAW!
