I have a question - this guy is living in a rent controlled apartment, he's leaving in a few months. He wants to take on a new roomate. The new roomate would be put into the rental agreement, and after a few months when the first guy leaves, he would get his own name taken out, and the new roomate would continue with the rent controlled apartment. Is this within the boundaries of legal or will the roomate not be able to do it?
The roommate will probably be able to stay (if he can afford to on his own and the landlord approves) but his rent will probably be brought up to market rate once the original tenant leaves. Rent controlled apartments usually can't be "inherited" where the rent stays the same - although, places like new york allow it. I don't know SF law though so I could be wrong.
