Can landlord charge for losses after potential renter does credit check but doesn't go through with lease? Need Advice!

I live in New Mexico. I gave landlord money for a credit check. I then told him I wasnt interested in the apartment after all. He then stated that I owe half a months rent! I only agreed to a credit check. I didnt put down any deposit at all. He was calling me asking for more phone numbers so he could get me approved for the apartment. I hadnt even been approved for the apartment yet and he wants half a months rent. Help.
