I did a CL deal for a basement apartment in the middle of a month. Paid 2 wks rent and 2 wks deposit for the remainder of the month
Receipt was promised, never came.
Although I was paying for the .5 of the month, the lease holder never made the room available, even after 3 days into the following month.
Finally get moved in only to discover the sewer backed up into the shower one day, the wiring in the whole house wasnt safe (blown circuits) AND there was actually no heat in the whole house as well
This all was not mentioned at all in the beginning
As I said, I stayed 1 mth and moved out 3 days into the next month. No notice, as I felt it was not healthy/safe to stay there for another 30 days.
Lease-holder has not returned my deposit, he even told me to write up a receipt and then we can "discuss" the terminology on it. ?! Since when does a renter write up their own lease
This all happened 2 mths ago and I just now have the time to do small claims. Does anyone know the statute of limitations of sth like this?
He wants you to write up a receipt or a lease? Did you have a lease? Did you check out the apartment before you sent a deposit? I agree, I would cut your losses and move on. How did you pay? By cash or check? Your cancelled check is your proof of payment. If you paid by cash, you're pretty much out of luck. If you have no proof that you paid, you are not going to be able to sue him.
You gave no notice, so you owe for the month you weren't there. You have to follow channels if the places was un-livable, not just move out without notice.
You are in the wrong, move on and forget it, like advised above... A cheap lesson for the future...
