Are lease is up in JUly and we aren't sure we want to keep renting here. Not that impress with the way the house was put together. The company we went from does yearly inspections which Iget but it makes me feel like a 2 year old. Some people who live in other houses are going to paint. I'm not we are moving out yet. I feellike they are just suppoose to come through and make sure you are keeping the house clean and in order. WE are doing that.When we moved in they had a 60 day walk through and when you move out they say they have 90 days to go through the home and return the damage deposit. I don't like that because I would want to be there when they walk through and I want them to show me what they are changing me for. How can you reallyfight or protect your self from them charging you or something or over charging you.

I believe they only legally have 30 days from the last day of residency to return the deposit to you. Also, they have to provide receipts proving any charges if they did decide to charge you. Also, you certainly ARE allowed to be there during the final walkthrough, and I would recommend taking pictures/video.

I have always gotten 100% of my deposits back. Take pictures, keep the place in good order. When you move out CLEAN. I have found the most efficent way to move is to clear out all rooms you don't need to use before moving day. Clean those rooms throughly and try not to go back in.
You have every right to be there when they do the walk through. Tell them before hand you intend to be there and make a date for when it will work for everyone. All the places I have lived stated they return the deposit within 30 days of the inspection. I usually had mine in hand when walking out the door.

You really need to know what the law is in your specific jurisdiction... it does vary from State to State and even from city to city...

Keep good records and document problems.

Ask for a pre-move out inspection if allowed...

Take pics, with a dat on the pics...that is very good proof...take a lot of pics and put them on a CD or usb stick and safe them till you get your money back.

I've always taken pictures. I've cleaned my carpets, and wiped down the walls, cleaned underneath appliances, kitchen cabinets and drawers thoroughly before moving out. I've never had a problem with not getting a deposit back.

You shouldn't have a problem (nobody should, actually), but sometimes the landlord wants free maintenance. If there's a history of this landlord scamming on movers, get an independent housing inspector to do a walk-through and document it. That's a little extreme, though. You probably have a short while (depending on local laws) to have the walk-through, about 45 days to get deposit back, and you should be present during inspection. Video is best for proof. Dates can be altered on the camera, but newspapers in the film prove the date. Paint, carpet... have life expectancies (usually 5 years) and are valueless afterward. Don't let them make you buy new things illegally.
