Tenant wants to move in before lease starts (deposit, legal, landlord)

No early moveins. They haven't paid the rent for those 6 days and your liability increases to somewhere in the stratosphere. If they want to move in early, amend the Lease to move up the date and charge rent. Their lack of planning is not your problem.
I have done it...had them put their stuff in the garage without charging...I learned my lesson...all was good till they vanished a month before the lease was over...
Now I changed it...they can move in early and pay pro rated...nice is only going as far as the tenants convenients...
I will charge for the six days! Your warnings and concerns are appreciated very much.
Don't feel bad about charging it, I know we all rather be nice and let them put it there or move in...but unfortunately times have changed. Tenants feel they are entitled to everything, but only know their side....
I routinely let tenants move in a few days early if all other requirements are met... i.e. deposit/rent paid, utilities transferred, unit ready to occupy
Simply document the terms and conditions of the early move-in on the lease...
I don't store anything for tenants due to liability concerns...

We've done this in the past but not for free - we were charged a pro-rated rent for the days we would be moving in. If there are 30 days in the month, and rent is let's say $800... then you just figure out the daily rent and multiply that by how many days early (prior to when the lease begins) that they are going to be moving in. If they are wanting to start moving their things in 6 days before the first, then charge them for 6 days...
This weekend we had one tenant move one day prior in than lease officially started. The owner didnt want to charge prorated rent but wanted the tenant to get the utilities in their name on that earlier date and that was put in writing and signed by tenants and also another condition regarding the legal issues that can arise.
The day after they moved in they called our office complaining that the water wasn't working...they found it ruse that the owner didnt leave it on longer in the owners name!

Of course you should charge for early move in! Just make sure everything (elec, water, gas etc) is already in their name and any money they owe you is paid up IN FULL. Just write something up to effect of the early move in and charge them a prorated amount, to be paid BEFORE the move in day.
I thinks it's awesome when a landlord lets someone move stuff over a few days early, but I also know that tenants can really be a problem when you allow them one concession.........
