I was looking through some homes for rent and came across one that said "No small children." Are they allowed to do that because someone owns the home and doesn't want kids at their house? I have seen homes for rent that specify no pets but this is the first time I have come across a rental property that says no small children. Thanks.

Yes, of course it's legal.

Unless they accept state or federal funding, the owner/landlord can place any restriction they want to on a rental.

Yep.

I'm having the same issue trying to find housing for someone who's disabled. Everytime I find a good place they have an age restriction or some other type of restriction that completely eliminates them as a consideration (so many disabled/handicapped residences have restrictions that the tenant must be mobile on their own with minimum assistance. Now I ask you, if you can readily stand up and walk, then why would you need that sort of housing)?

Yes, it's legal. Unfortunately, small children tend to take crayons to the walls and make messes that some people don't want to deal with - same with pets. Keep looking and I'm sure you'll find a place that's suitable. Best wishes.

Actually, unless they fit into one of the very few exceptions, that's a violation of the federal Fair Housing Law - they're discriminating based on familial status, which is one of the protected classes. (Read the first paragraph on that page.)

If you're looking to rent an apartment in their home, however, that falls into one (actually likely a couple, unless they have more than 4 apartments in their house) of the exceptions.

Thanks for the link TexasHorseLady. I was just browsing homes for rent...stuck in my apartment for another 6 months and I just found it strange when I saw "no small children," so I thought I would ask. Another thing I don't get is why some rentals will allow dogs and not cats. Dogs seem like the messier and smellier of the two but maybe that's just me!

Cats can scratch walls as well as furniture, and cat odor is VERY difficult to get rid of. But dogs have their issues, as well!

See that's strange to me because if I pet a cat, and smell my hand, it doesn't smell like anything but if I pet a dog and smell my hand, it smells like, well, dog. Oh, the joys of renting!
