I'm researching fair housing laws and cases, and found this old case from 2000. I just found it fascinating. What kind of justification could this landlord have had to require lead tests for children under 6? Just some bizarre creative way to scare off tenants with children?


Fair Housing
Two Baltimore mothers and a nonprofit fair housing organization, Baltimore Neighborhoods Inc., have settled a lawsuit filed against a firm, which refused to rent to families with children who have high levels of lead in their blood. Under the terms of the settlement, the firm will discontinue its practice of requiring lead testing for children under six and will pay $13,000 in damages. The suit alleged that the firm violated the Fair Housing Act, which prohibits discrimination against families with children.

Baltimore is lead paint central on the East Coast. I vaguely remember this case but vague is the key word.

There were a bunch of lawsuits against landlords which ended up costing millions of dollars in damages to kids who had been injured injesting lead paint.

My guess is that landlords required a lead test to establish a baseline so tenants couldn't come back later and sue for previously high lead levels.

Exactly. It's similar to the issue with asbestos in old buildings - it's lawsuit bait even if the owner didn't cause whoever to get sick. But it's still illegal to discriminate against children and families with children, which requiring kid blood tests would be, so the the court smacked them down.

Wow. That makes perfect sense then. A baseline. Even today I have to give tenants an informational booklet regarding lead paint because of the age of the building. Very interesting.

Yes, lots of kids ended up with health problems up to brain damage from lead paint chips. Sad.

Not knowing the legalities but can't a waiver/disclaimer of sorts be included with the last? Saying I anything happened regarding lead paint it isn't the ll's fault?
