I thought it was a contractual duty to self report SS income when on long term disability. If your LTD policy states what you receive will be offset by SS, to not report or under report would be fraud.

Usually it's the insurance company that deducts the SSDI amount, not your employer. So your employer would not normally know how much you receive in SSDI benefits. In fact, most employers do not know that you are receiving benefits. Are you a government employee?

Under the terms of some LTD policies, payment of the benefit comes directly from the employer, even in the private sector. However, the insurance carrier is responsible for maintaining records.

The only think I can think of is that somewhere in the ream of papers you had to sign was a release for access to your financial records and the claims investigator found out that way. If you received back payment from SS, that has to be turned over as well and they can and will offset your benefit by any unreported amounts.

When I worked, employer's LTD provided that total payments of SSDI and LTD could not exceed 60% of gross pay at the time disabled. A carveout of this type is pretty common.

I was on STD twice in the 26 years I with that employer. Paperwork from the STD Administrator - Northwestern Mutual Life - was intrusive and unrelenting. Imagine LTD is also pretty bad.

Yes, OP, you probably signed something somewhere authorizing release of this information - or no LTD for you.
