I know that if you were married at least ten years and then divorced at least 2 years you can collect on your X-spouses record, and I know that if you were married and your spouse dies, you must have been married at least 9 months to collect survivor benefits.

What I would like to know is if you widowed and remarry, is there any waiting period to file for spousal benefits on the New spouse?

In other words if my widowed sister in law, 63 years old, remarries doe she have to wait to file for spousal benefits on her new husbands account? She is currently getting about $750 a month on her own account which she began at 62.

I'm confused... is she planning on doing away with her new spouse? putting up with him until she can collect?

Very Funny,

I just wondered if she marries him if she could file on his record right away thereby increasing the benefit she receives, OR if there was a waiting period such as those I mentioned in other situations.

I have not even spoken to her about it, I was just curious.

For a Social Security spouse's benefit your sister must be legally married to her new spouse for a continuous year.

can you tell me where to find that information? I have been searching the SS gov. site and so far have found nothing saying that, or any other amount of time.

Ok I did find it in a SS publication. Always good to have the correct facts.
