I recently got a ticket for doing 61 in a 40. I know it was very stupid of me and I will be wagching my speed much closer now. The thing is the officer put down 51 on the ticket under actual speed. If I go to court to fight it (with a request for good driving record for the past three years)? I know the rule is you had to be doing less than 14mph over to apply for the request. So my question is can I go to court and use this or can the officer tell the judge my speed was 61 and my case gets thrown out?

If it says you had to be going 14 or less, and the officer put down 51, that's only 11. You should be fine. He probably did that so you would qualify for the good driving request.

I hope they throw the book at you. I hope the judge is a member of the Taliban. Endangering lives by reckless driving is an abomination. In Iran, they probably would behead you; be thankful you don't live in Iran.

If you have no record, you can file a motion pursuant to the good driving statute. The officer wrote you up for less than 15 mph over so you are within the law. I bet you'll see a "61" with a circle around it somewhere on your citation. The judge will refer to that if you try to get the ticket thrown out on a procedural shortfall on the officer's part.

If you were driving around in Rhode Island without your Obama sticker on the car, you are at fault.

I know I am late to this thread, but I also live in RI and just got pulled over with a similar situation to yours. I am considering the good driving record plea as well. Did it end up working for you? Thanks.

You are fighting a 51 in a 40 ticket. That's what it says on your ticket so that's what it is. You agreed to put your initials at the bottom of the ticket that he or she wrote you. You put your initials on the ticket and agreed that you were going 51mph. The ticket is a form of a contract. He or she signed, you signed. If the officer changes the speed the officer will be violating the contract.
