Hello,
Recently I received a Reckless driving speeding ticket in Henrico County, my charge is RD-SP IN EXCESS 80 MPH-MISD. I was looking for some advice as to how I may be able to get out of my ticket or at least avoid jail time, and if i were lucky avoid suspension of my licenses. Paying the fine I would not mind at all. The posted speed limit was 70, I was paced at 104. Im planning on getting a govner set in my car to reduce the speed my car can accelerate to and to attend a driving class before court day. Im also hoping the judge notices that I am from out of state and a full time student in my state. Any advice would be greatly appreciated thank you.

I have plenty of advice I could offer but only one thing that really matters. HIRE an attorney. 104? Come on. You can't expect good things to come from this I hope you realize. At 104 you can certainly expect a suspended license and possibly a day in jail. But to minimize the dame you need an attorney. If it were 82/70 this would be much easier but in your case, attorney.

A little bit off topic here, where in NoVA has speed limit of 70? I've lived in NoVA since 1999 but haven't seen speed limit of 70 ever.

You were driving 104 mph! If I were a judge I would sentence you to community service in a hospital emergency room so you could see what people look like after they have been mangled in an auto accident. You need a reality check.

You probably haven't. The OP was pulled over in suburban Richmond, where the first speed limit changes from 65 to 70 mph took effect last month.

I'm not sure why being a full time student from out of state would help you out at all, to be honest. It's not like driving 104 mph is acceptable in any state within a day's drive of Virginia, so you can't claim ignorance of the law.

So why is this in the Nova forum?

It should probably be moved to the Richmond or the general Virginia forum. I know we periodically debate how big NoVA is, but I don't think it includes the Richmond burbs...yet.

As Henrico County is indeed in the Richmond area, I'm moving this thread to the Richmond forum.

This is Virginia. A law and order state, still. Don't expect much leniency from a judge for driving 104 on a highway in the Commonwealth. Man up and pay the fine, and do the time. And get a lawyer, you'll need one. (Ask your lawyer to give you a legal opinion on whether you'll have a criminal record if convicted of this charge. You might be surprised at the answer).
