The only reason I can think of that a person would refuse is if they had been drinking. If they are innocent, then they can erase any probable cause the officer might have and be on their merry way.

But if they are sober and refuse, then they're going to have to deal with the ramifications of that decision. Still, why any innocent person would do so is beyond me...

More questions: what ramifications are there with refusing a test while being innocent? Maybe they're trying to flex their constitutional rights, whatever. Maybe they're mistrustful of police and they believe that the breathalyzer is miscalibrated and will claim they're drunk when they're not. Who knows? Does it really matter?

So what will the ramifications be? It's not like they can do anything to a person proven INNOCENT

What do you do if a shady officer misrepresents the field sobriety test or if the breathalyzer is inaccurate? At that point, wouldn't someone want their blood to be drawn to disprove the officer's findings? Wasn't there a judge who said an SAPD officer exaggerated his behavior when pulled over and a video at the police station showed him acting completely the opposite as the officer reported? I don't know if he was lying or not because he did refuse to take a breath test, but it could happen.

Try doing some of those sobriety tests when you're completely sober. They're designed to make everyone look like an idiot. I wouldn't take them under any circumstances and my truck will still start even if I don't have a valid license.

"They'll have to sit at a desk and fill out paperwork" isn't much of a deterrent to keep officers from making everyone do the tests when they're getting paid either way.

No, they are not designed to be easy; but they are a good indicator as to whether a person is impaired.

Nice comment, I'm glad you are so critical of the police; but are so willing to drive without a license! Why bother with insurance either? It's just a waste of money as well! It could be better spent on 22" rims for your truck or buying fireworks. Y'know, more important things...

Follow this pen with your eyes while standing on one foot and recite your ABC's backwards while you're at it. I can barely do that sober let alone wasted.

people whining that SAPD is handing out DUI's to make money.

Do a Google search with this term: "san antonio sobriety test"

Then tell me who's making the money....

The lawyers get people who drink and drive to believe if they only hire them they can beat the charge...

Only way to beat a charge is to not get a charge in the first place. That is common sense which some folks do not have in these parts.

Oh, but people in "other parts" do have common sense and don't drink and drive?
