We had a clean brush pickup on April 1st, and I noticed my neighbor placing bags of leaves out by the curb on the weekend before. Unfortunately, he put them in the plastic garbage bags (about 20-25 total) and they were obviously not picked up. Now, here we are four weeks later, and they're still sitting out there.

It's strange, because the guy is meticulous about his front lawn, so it's odd to me that he would let them sit out there for this long. He's even been out front and blown the leaves/pollen that settled OFF OF THE TOP of the bags.

What options do I have?

I know that someone called 311 and Code Compliance said they'd send someone out to handle it. That was two weeks ago, and I don't have any idea what happened - because they're still out there.

HOA will just email him a letter that he'll ignore, I'm sure.

Is there any thing that can be done, short of removing them ourselves? Is there a way to actually get them picked up, or are we at the mercy of this guy actually doing something about it?

Good luck...we have several neighbors like that. It never used to be that way around here until the housing meltdown and we got lots of renters and hurricane refugees. I do not understand why people buy or rent in an HOA neighborhood and then think the rules are for everyone but them.
I give our HOA a C- as far as enforcement.
We spent 1/2 of Saturday picking up litter and frankly, I'm sick of it. Never have I had to do that before moving here.

Code compliance sends a letter. Then they have 2 weeks to comply, if not, they get a fine. You can call code compliance again.

Call the management company and complain. Chances are the manager does a drive-by once or twice a month. S/he wouldn't know if something has been out on the curb for weeks unless it was noted on the previous visit.

He may be waiting for a bagged leaf pick up by the city. I do recall reading something about not putting out your bagged leaves for brush pick up. There was a number to call for the city to pick up the bagged leaves. You could probably call 311 and ask to be sure.

Have you asked him about them? You could suggest him calling 311 or posting them on craig's list and see if someone wants them for mulch. A little communication about the problem goes a long way to keep neighborly relationships neighborly than calling Code Compliance or HOA without first checking with them. Hopefully you won't get an ugly response, just a frustrated neighbor who is having problems with leaf pick up.

IIRC, it's OK to put out bagged leaves as long as the bags aren't sealed.

Not any more, at least not for brush pick up. It stated it on the hang tag this time. It's also on the website.

You can request two leaf bag pick ups a year and the bags need to be those kraft paper bags and they must be sealed. Read more at:
