Hello, I Rarely Post, Most Just Enjoy Reading Everyones Comments And I Love The Diversity Sa Has To Offer. Now My Post, I Need Help!!
Here's The Story, We Are Building A New Custom Home, Great Architect And Builder But 6 Weeks Into The Project The Builders Wife Passes Away. Right At Closing She Was Seriously Ill And We Asked The Builder If He Wanted To Hold Off But He Declined. She Got Better And Then Suddenly Passed Away. The Problems...
He Allowed Foundation People To Destroy Many Trees On The Property, The Framers Put Up Two Walls Wrong, He Had A Trash Dumpster Delivered And They Left It My New Neighbors Front Yard.
We Have Worked Most Thins Out, Neighbors Okay But Still Waiting To Get Dumpster Moved, Architect Came Out And Met With Framers To Get Them To Fix The Walls At A Cost Of 150 Dollars An Hour.
I Know This Guy Just Lost His Wife But I Also Want To Protect Myself, I Want Things Done Right, I Plan To Grow Old In This House.
Do I Ask The Builder To Pay For The Extra Cost To Have The Architect Come Out, To Pay For Trees? Am I Being Too Cold?

Actually I do not feel you are being cold. It is a hard circumstance for the contractor, but if this happened and there was no one on site to manage the project, I would feel they need to pay for the results. If you had discussed not taking down trees and trees went down.. then they should pay for the new trees. However, if the subject was never brought up then you would need to pay for the trees. The walls.. that is self explanatory, if they put walls in the wrong place and it was not on the blueprints that you approved.. then they should also be paying for that. Again.. if you approved any of this.. and are now deciding to make changes midstream, then you should be responsible for it.

You need to look at your contract. I would expect that there will be something in there stating you need to work out any differences with the contractor. Unless he's inclined otherwise you may end up eating the cost of the architect.

Get the dumpster moved immediately!

If you had some type of hardship, the builder woudn't care. They would still want their moeny. You can send a sympathy card or something since loosing a spouse is tragic but your house and his spouse or two separate issue. Your house is strictly business
